Guest Terms of Service

By approving this transaction, signing, and/or clicking the accept button below, you (“User”) agree to the terms and conditions outlined below by Beachside Services LI (“Beachside”). Beachside agrees to provide, and User agrees to receive, certain services [including, but not limited to, pick-up, delivery, set-up, and return of personal property of the User (“Services”)], and/or tangible personal property [including, but not limited to, beach chairs, tents, umbrellas, coolers, beach toys (“Equipment”)]. This Agreement is made in consideration of the mutual promises set forth herein. 1. Eligibility & Authority User affirms they are over the age of eighteen (18) and legally authorized to bind all individuals using the Services and/or Equipment. 2. Intended Use User agrees to use the Equipment in a safe, proper manner for its intended purpose only. 3. Assumption of Risk User acknowledges the inherent risks of beach activities, including but not limited to: sunburn, heat stroke, dehydration, drowning, rip currents, marine life encounters, tripping hazards, wind-blown debris, and injury from other beachgoers. User voluntarily assumes all such risks. 4. Waiver of Liability for Injury or Death User releases and discharges Beachside from any and all claims for injury, illness, death, or property damage arising out of the use of the Services or Equipment, whether caused by Beachside’s negligence or otherwise. 5. Loss, Theft & Damage Beachside is not responsible for any loss, theft, or damage to User’s personal property. User is solely responsible for all Equipment in their possession and shall bear all risks of loss or damage, regardless of cause. 6. Weather & Force Majeure Beachside is not responsible for service interruptions caused by weather, tide, wind, acts of God, or other conditions beyond its control. No refunds or credits will be issued due to such events unless otherwise stated in writing. 7. Placement of Equipment Beachside will place Equipment in reasonable proximity to the requested location, subject to beach conditions and regulations. Exact placement is not guaranteed. 8. Relocation Prohibited User may not relocate Equipment once set up by Beachside. 9. Return of Equipment User shall return Equipment in good repair by 5:00 PM on the day of rental unless otherwise agreed in writing. Late returns or unreturned items will incur replacement charges at full retail value. 10. Cancellations & Refunds Cancellations must be made within the time frame specified at booking. Refunds are not available once Services or Equipment have been used or after the start of the rental period. 11. Behavioral Conduct User agrees not to engage in illegal activity, excessive alcohol consumption, or disruptive behavior while using the Services or Equipment. Beachside reserves the right to terminate Services without refund if this clause is violated. 12. Indemnification User shall indemnify, defend, and hold Beachside harmless from all claims, damages, losses, and expenses (including attorney’s fees) arising from or related to User’s use of the Services or Equipment, including claims by third parties. 13. Ownership All Equipment remains the exclusive property of Beachside. User has no right to sell, lease, or alter it. 14. Client Cooperation During Emergencies In the event of a safety concern, weather-related evacuation, medical emergency, or any other unforeseen situation, User agrees to follow all instructions provided by Beachside staff or authorized personnel promptly and without objection. Failure to comply may result in immediate termination of Services without refund. 15. Media Release User grants Beachside the irrevocable right and permission to capture, use, and publish photographs, video, or audio recordings taken during the provision of Services for promotional, advertising, and social media purposes, without further consent or compensation. If the User wishes to opt out, they must notify Beachside in writing prior to the start of Services. 16. No Supervision of Minors Beachside does not provide childcare or supervision of minors at any time. All minors under the age of eighteen (18) must be accompanied and supervised by a parent or legal guardian at all times. Beachside assumes no responsibility for injury, accident, or incident involving minors, regardless of cause. 17. Dispute Resolution & Governing Law All disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association. Venue shall be Nassau County, New York. This Agreement shall be governed by New York law. 18. Entire Agreement & Modification This Agreement constitutes the entire understanding between the parties and may only be modified in writing signed by both parties. 19. Notice All notices will be deemed sufficient if given in person or emailed to the address provided during booking.
